Meta Takes Ofcom to Court Over Online Safety Rules
The company has appealed Ofcom’s decision to place WhatsApp and Instagram under a regulatory category that carries additional obligations. These requirements include greater transparency, expanded tools for users and measures aimed at addressing fraudulent advertising and unlawful content, according to reports.
The latest case adds to a growing number of legal disputes between technology companies and Ofcom concerning the implementation of the online safety framework.
Meta previously challenged Ofcom’s approach to calculating regulatory fees in May, arguing that charges should not be determined using a company’s worldwide revenue.
Under the Online Safety Act, companies that fail to meet applicable requirements can face penalties of up to 10% of qualifying global revenue or £18 million ($24 million), whichever amount is greater.
Other major technology platforms are also challenging aspects of the regulator’s requirements. TikTok and X have initiated legal proceedings concerning the volume and type of information they are required to provide to Ofcom.
Oliver Griffiths, Ofcom’s group director for online safety, told a House of Lords committee that the regulator was working in what he described as “operating in a highly litigious environment.”
Griffiths said Ofcom remained focused on enforcing the legislation effectively, but acknowledged that regulatory decisions could expose the authority to major legal consequences if it took “unnecessary risks.”
